Labor Law
The Labour Law of the Republic of Serbia regulates the rights, obligations, and responsibilities of employees and employers. Its purpose is to ensure a balance between the interests of workers and employers, while respecting the fundamental principles of labour law, such as freedom of work, equality, protection of employees’ dignity, and workplace safety.
Obligations Law
The Law on Obligations represents the fundamental regulation of civil law governing contractual and non-contractual relations between natural and legal persons. Its purpose is to ensure legal certainty in the circulation of goods, services, and money, while upholding the principles of good faith, equal value of reciprocal performances, and the prohibition of abuse of rights.
This law defines the general rules regarding the creation, performance, and termination of obligations, liability for damages, unjust enrichment, as well as various types of contracts, such as contracts of sale, lease, loan, service contracts, and others.
Civil Procedure Law
The Law on Civil Procedure regulates the rules by which courts conduct civil proceedings for the protection of subjective rights and legal interests of natural and legal persons. The purpose of the law is to ensure fair, efficient, and lawful proceedings, in accordance with the principles of equality of the parties and the right to a fair trial.
This law prescribes the manner in which a lawsuit is initiated, how the main hearing is conducted, the presentation of evidence, the rendering of judgments, as well as the exercise of legal protection through appeals and extraordinary legal remedies.
Planning and Construction Law
The Law on Planning and Construction regulates the conditions and procedures for spatial and urban planning, the issuance of construction permits, the construction of buildings, as well as the legalization of unlawfully constructed facilities in the Republic of Serbia. The purpose of this law is to ensure orderly spatial development, sustainable growth, and compliance with technical and safety standards in construction.
The law defines the rights and obligations of all participants in the construction process — investors, designers, contractors, and supervisory authorities — as well as the procedures for obtaining location conditions, construction permits, occupancy permits, and for the conversion of usage rights into ownership rights.
General Administrative Procedure Law
The Law on General Administrative Procedure regulates the rules under which state authorities, bodies of autonomous provinces, local self-government units, and public services decide on the rights, obligations, and legal interests of citizens and legal entities. Its goal is to ensure legality, efficiency, and fairness in the work of public administration.
This law prescribes the principles of administrative procedure, the manner of initiating proceedings, participation of parties, presentation of evidence, adoption and enforcement of decisions, as well as the use of legal remedies, appeals, and administrative disputes.
Companies regulates Law
The Law on Companies regulates the establishment, organization, operation, and termination of business entities in the Republic of Serbia. This law defines the forms of business companies — general partnership, limited partnership, limited liability company (LLC), and joint-stock company (JSC) — as well as the rights and obligations of members, founders, and management bodies.
The law contains provisions on the founding act, capital, profit distribution, members’ liability, status changes (merger, acquisition, division, change of legal form), and the liquidation and bankruptcy of companies. Its purpose is to ensure legal certainty and transparency in business operations, while protecting the interests of members and third parties.
Road Traffic Law
The Law on Road Traffic Safety regulates the rules of conduct for participants in traffic, the conditions under which vehicles and drivers may participate in traffic, as well as measures aimed at improving safety and reducing the number of traffic accidents. Its goal is to protect the lives, health, and property of all traffic participants.
This law governs issues such as road traffic regulations, speed limits, obligations of drivers and pedestrians, the use of alcohol and psychoactive substances in traffic, license suspension, as well as liability for traffic offenses and accidents.
Value Added Tax Law
The Value Added Tax (VAT) Law regulates the application of VAT in the Republic of Serbia, one of the most important forms of indirect taxation. The purpose of the law is to ensure the proper and transparent collection of tax on the turnover of goods and services, while respecting the tax obligations of taxpayers.
The law defines the concepts of VAT taxpayers, tax base, VAT rates, as well as conditions for exemptions and tax refunds. It also prescribes rules for the calculation, reporting, and payment of VAT, along with penalties for non-compliance.
Misdemeanors Law
The Law on Misdemeanors regulates the procedures for establishing and sanctioning misdemeanors. This law governs the rights and obligations of parties in misdemeanor proceedings, the jurisdiction of authorities, types of misdemeanors, the imposition of penalties and measures, as well as the possibilities for appeals and other legal remedies.
Family Law
The Family Law regulates the legal relationships between family members, including marriage, common-law partnerships, parental rights and obligations, guardianship, adoption, alimony, and domestic violence. The purpose of the law is to ensure legal certainty, protect the rights of children and other family members, and resolve conflicts fairly.
The law sets out the conditions for entering into and terminating marriage, divorce, the legal status of children, regulation of guardianship and custody, as well as maintenance obligations. It also regulates the protection of victims of domestic violence and measures for its prevention.
Occupational Safety and Health Law
The Law on Occupational Safety and Health regulates the rights and obligations of employers and employees with the aim of ensuring safe and healthy working conditions. The purpose of the law is to prevent injuries, occupational diseases, and to protect workers’ health during the performance of work tasks.
The law sets out safety measures at work, obligations for risk assessment, employee training, as well as supervision over the implementation of regulations. It also defines workers’ rights to a safe working environment and employers’ duties to provide the necessary conditions for health and safety protection.
Inheritance Law
The Law on Inheritance regulates the rules concerning the transfer of property, rights, and obligations from a deceased person to their heirs. The purpose of the law is to ensure a fair and lawful procedure for the distribution of assets, protect the rights of heirs, and resolve inheritance disputes.
The law defines the types of inheritance, the order of heirs, the opening and closing of inheritance proceedings, as well as rules regarding wills, compulsory portions for heirs, and the resolution of inheritance conflicts.
Tax Procedure and Tax Administration Law
The Law on Tax Procedure and Tax Administration regulates the rights and obligations of taxpayers and tax authorities in the procedures for determining, collecting, and controlling tax liabilities. The purpose of the law is to ensure a transparent, fair, and efficient tax process while protecting the rights of taxpayers.
The law governs the procedures for conducting tax proceedings, taxpayers’ obligations in reporting and paying taxes, as well as the authority of the tax administration in controlling and collecting tax revenues. It also prescribes legal remedies, appeals, and procedures for resolving disputes between tax authorities and taxpayers.
Court Fees Law
The Law on Court Fees regulates the obligation to pay fees when initiating and conducting judicial and other administrative proceedings. The purpose of the law is to provide financial compensation for the work of courts and other authorities, with clear determination of the amount and method of payment of court fees.
The law governs the types of fees, bases for calculation, exemptions and reductions, as well as procedures for payment and refund of fees. It also prescribes the responsibilities of parties and consequences of incorrect payment.
Public Order and Peace Law
The Law on Public Order and Peace regulates rules and measures for the protection of public order, peace, and the safety of citizens. The purpose of the law is to prevent and sanction behavior that threatens public order, disturbs peace, or endangers the safety of people and property.
The law defines misdemeanors such as disturbing public order, violent behavior, violation of prohibitions, and other forms of disrupting public peace. It also prescribes measures for the actions of law enforcement authorities, sanctions, and the rights of parties in proceedings.
Fundamentals of Property Rights Law
The Law on the Fundamentals of Property Rights regulates the rights and obligations related to the acquisition, use, and disposal of property, as well as the protection of property rights. The purpose of the law is to ensure legal certainty in the transfer of real estate and other assets, as well as to protect the rights of owners and users of property.
The law governs methods of acquiring ownership, joint ownership, rights in rem and other related rights, as well as the protection of property rights through appropriate legal remedies.
Pension and Disability Insurance Law
The Law on Pension and Disability Insurance regulates the conditions, rights, and obligations within the pension and disability insurance system in the Republic of Serbia. The purpose of the law is to provide financial security and social protection for insured persons and their families through the right to a pension, disability benefits, and other entitlements.
The law defines the conditions for acquiring pension rights, types of pensions, procedures for exercising rights, as well as rights to disability protection and other forms of social assistance.
Housing and Building Maintenance Law
The Law on Housing and Building Maintenance regulates the relationships between tenants, owners, and building managers to ensure efficient maintenance and management of residential buildings. The purpose of the law is to provide conditions for safe and quality housing, as well as fair distribution of maintenance costs.
The law sets out the rights and obligations of tenants, organization of building management, maintenance of common areas and facilities, as well as procedures for resolving disputes between users and building managers.
Foreigners Law
The Law on Foreigners regulates the conditions for entry, stay, work, and rights of foreigners in the territory of the Republic of Serbia. The purpose of the law is to provide a legal framework for the safe, lawful, and controlled presence of foreigners, while respecting their rights and the interests of the state.
The law governs procedures for obtaining visas, residence and work permits, as well as conditions for asylum, prevention of illegal stay, and enforcement measures. It also defines the rights and obligations of foreigners and the competences of state authorities.
Criminal Code
The Criminal Code regulates criminal offenses, their elements, criminal sanctions, and security measures in the Republic of Serbia. The purpose of the law is to protect social values, ensure citizens’ safety, and fairly punish perpetrators of criminal offenses.
The law defines various types of criminal offenses, the punishments that may be imposed, and the procedures for their application. It also regulates liability, mitigating and aggravating circumstances, as well as the rights and obligations of the accused and victims.
Criminal Procedure Code
The Criminal Procedure Code regulates the rules and procedures for conducting criminal proceedings in the Republic of Serbia. The purpose of the law is to ensure a fair, efficient, and lawful process aimed at establishing the truth and protecting the rights of all participants.
The law defines the jurisdiction of courts and other authorities, the rights and obligations of the accused, victims, and other participants, as well as the stages of the procedure, from investigation and main trial to the issuance of a verdict. It also regulates security measures, legal remedies, and appeal procedures.
